Terms of Service

These Terms of Service ("Terms") govern your use of the Pruvstamp application and website (collectively, the "Service") operated by Pruvstamp ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Pruvstamp provides a media authenticity certification platform. The Service allows users to cryptographically certify photos and videos by anchoring file hashes on a public blockchain. Pruvstamp does not guarantee the truthfulness, accuracy, or legality of any content certified through the Service. Certification confirms only that a specific file existed at a specific time and was captured on a specific device.
2. Eligibility
You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our sole discretion, without prior notice, for any reason including violation of these Terms.
4. User Content and Conduct
You retain ownership of all content you certify through the Service. You are solely responsible for the content you certify, upload, share, or list on the marketplace. You represent and warrant that you have all necessary rights to the content and that your content does not violate any applicable law or third-party rights.
The following content is strictly prohibited and may result in immediate account termination without notice: child sexual abuse material (CSAM); content promoting terrorism or violent extremism; non-consensual intimate imagery; content that violates applicable export control or sanctions laws.
We reserve the right, but have no obligation, to review, moderate, or remove any content at our sole discretion. We may report illegal content to law enforcement authorities as required by applicable law, and may disclose user data or content when compelled by valid legal process.
Public content moderation. Files you make publicly accessible — via marketplace listings or your public channel — undergo automated content analysis. Files identified as containing prohibited content may be blocked from publication, removed without notice, and may trigger account suspension.
Private content. Files that remain in your private library are not automatically scanned. We rely on user reporting and law enforcement referrals to identify prohibited content in private storage. By using the Service, you agree not to store prohibited content even when private.
5. Blockchain Immutability
You acknowledge and agree that certification hashes written to a public blockchain are permanent and cannot be deleted, modified, or revoked by Pruvstamp or any third party. Account deletion removes your data from Pruvstamp systems but does not and cannot remove on-chain records. By certifying content, you consent to this permanent record.
6. Subscriptions and Payments
Paid subscriptions are billed in advance on a monthly basis through Stripe. All fees are non-refundable except as required by applicable law. We may change pricing at any time with 30 days notice ; significant changes to consumer tiers are grandfathered for existing subscribers at their current price for at least 12 months. Failure to pay results in immediate suspension of premium features. You may cancel at any time ; cancellation takes effect at the end of the current billing period.
Streaming bandwidth. Each paid tier includes a monthly streaming bandwidth quota for public-facing content (channel views, share link streams, marketplace previews). The quota resets at the start of each billing period. When the quota is exhausted, public previews are temporarily replaced with an upgrade prompt until the next reset or until you purchase additional capacity.
Bandwidth overage packs (Media tier only). If you are on the Media tier you may purchase one-time bandwidth packs from your account page when approaching or exceeding your monthly quota. Pack sizes and prices are listed on the purchase page (currently +500 GB / $6, +2 TB / $22, +5 TB / $50). Packs are activated immediately on successful payment and expire 90 days from purchase. Unused capacity at expiry is forfeited. Pack purchases are one-time charges, billed separately from the monthly subscription, and are non-refundable except where required by applicable law. Post-purchase downloads from the marketplace by buyers are not charged against the seller's bandwidth quota — that bandwidth is covered by the marketplace commission.
7. Marketplace and Affiliate Program
The marketplace enables users to buy and sell certified content. Pruvstamp acts solely as an intermediary platform and is not a party to any transaction between buyers and sellers. We do not guarantee the quality, accuracy, legality, or fitness for any purpose of marketplace content. Sellers are responsible for ensuring they have the right to sell their content. Pruvstamp charges a commission on marketplace sales as specified in the applicable pricing schedule.
Ownership transfer on sale. When a buyer completes payment for a listed content, all rights to that content — use, distribution, sharing, re-sale — transfer entirely to the buyer at the moment payment is confirmed. The seller irrevocably relinquishes these rights and commits to deleting any local copies of the content from devices and storage under their control. Pruvstamp removes the sold content from the seller's Pruvstamp cloud automatically but does not — and cannot — verify or enforce the deletion of local copies held on seller-owned hardware. The marketplace operates on a good-faith trust model between sellers and buyers. Any use, sharing, distribution, or further sale of sold content by a previous owner after the sale is confirmed constitutes a breach of these Terms and may expose the violator to civil and criminal liability. Disputes are addressed via notice-and-takedown to contact@pruvstamp.com and governed by Section 14.
Secondary market. A buyer who acquires content via the marketplace becomes the sole owner and may list the content for resale at any time. Each successive sale repeats the ownership-transfer flow described above ; previous owners lose all rights and access on Pruvstamp the moment the new sale is confirmed.
Pruvstamp may offer an Affiliate Program enabling users to earn commissions on referred subscriptions. A referral code can be associated with a referred account only if attached within thirty (30) days of that account's creation, whether automatically via the referral link cookie / deep link or manually entered in the account settings. After this thirty-day window expires, no further referral attribution is possible for that account and no commissions will be retroactively generated. A referral code cannot be applied to the affiliate's own account. Commissions are earned only on subscriptions paid by the referred account and accrue for the first six (6) months after the referred user's first paid subscription starts, subject to clawbacks for refunds, chargebacks, or fraud. Pruvstamp may adjust commission rates, eligibility, hold periods, payout thresholds, and program terms at its sole discretion with reasonable notice. Suspended or terminated accounts forfeit unpaid commissions.
8. Intellectual Property
The Service, including its design, code, trademarks, and underlying technology (including any patents or patent applications), is the exclusive property of Pruvstamp. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms. You may not reverse-engineer, decompile, or attempt to extract the source code of the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT CERTIFICATIONS WILL BE ACCEPTED AS EVIDENCE BY ANY COURT, AUTHORITY, OR THIRD PARTY. WE MAKE NO REPRESENTATIONS REGARDING THE LEGAL ADMISSIBILITY OR EVIDENTIARY VALUE OF CERTIFICATIONS IN ANY JURISDICTION.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRUVSTAMP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO PRUVSTAMP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless Pruvstamp and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.
12. DMCA and Copyright
If you believe content on the Service infringes your copyright, contact us at contact@pruvstamp.com with a description of the copyrighted work, the location of the allegedly infringing content, and your contact information. We will process valid takedown requests in accordance with applicable law. Note that certification hashes on the blockchain cannot be removed; takedown applies to files hosted on Pruvstamp systems only.
We may, at our sole discretion, suspend or terminate accounts of users who repeatedly post infringing content.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 9, 10, 11, and 14 survive termination.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE. You waive any objection to venue or jurisdiction in such courts.
15. Changes to Terms
We may modify these Terms at any time by posting the updated version on this page. Material changes will be communicated via the Service or email. Continued use of the Service after changes constitutes acceptance. If you do not agree to the modified Terms, you must stop using the Service.
